Merchant Code of Conduct Policy

1. Ethical Business Practices

All merchants using SRCheckFlow agree to conduct business ethically and in accordance with all applicable laws and regulations. Merchants must:

  • Operate their business in compliance with federal, state, and local laws
  • Provide accurate and truthful information in all transactions
  • Treat customers with respect and fairness
  • Maintain transparent business practices
  • Disclose all material terms and conditions to customers

2. Authorization and Consent

Merchants must obtain proper written authorization from customers before initiating any eCheck transactions. Authorization must:

  • Be in writing or via electronic signature
  • Clearly specify the amount, payee, and transaction purpose
  • Be obtained before the eCheck is submitted
  • Be retained for audit and verification purposes
  • Include confirmation that the customer understands the transaction

3. Prohibited Activities

Merchants agree NOT to engage in the following activities:

  • Fraudulent transactions or misrepresentation of goods/services
  • Processing eChecks without proper customer authorization
  • Duplicate transactions or repeated billing without consent
  • Using customer banking information for unauthorized purposes
  • Engaging in money laundering or financing of illegal activities
  • Processing transactions related to illegal products or services
  • Harassment, abuse, or coercion of customers
  • Manipulation of transaction records or falsification of documents

4. Customer Data Protection

Merchants must protect customer financial information and comply with:

  • PCI-DSS requirements for payment card security
  • Privacy laws and regulations
  • Data retention policies
  • Secure disposal of customer information
  • Limitations on sharing customer data with third parties

5. Dispute Resolution

In case of disputes:

  • Merchants agree to work cooperatively with customers to resolve disputes
  • Merchants must respond to customer inquiries within 10 business days
  • Merchants accept responsibility for transaction accuracy
  • Merchants agree to follow ACH dispute procedures
  • Merchants must maintain records to support transactions

6. Compliance and Auditing

Merchants agree to:

  • Allow SRCheckFlow to audit transactions and records as necessary
  • Maintain accurate transaction documentation
  • Report suspicious activities or potential fraud
  • Comply with regulatory inquiries and audits
  • Provide requested documentation within specified timeframes

7. Consequences of Violation

Merchants in violation of this Code of Conduct may face:

  • Suspension of account privileges
  • Termination of merchant agreement
  • Forfeiture of funds or chargebacks
  • Referral to law enforcement if illegal activity is involved
  • Liability for damages caused by violations
